This document sets out the terms of use of hawjan.com, operated by Hawjan. It explains the nature of the content published here, the intellectual property rights attached to it, and the limits of our liability towards those who use it. By using the site you confirm that you have read and accepted these terms.
Nature of the content: general information only
The content published on this site, including the services, solutions, work and blog pages, is provided to introduce HAWJAN and its services and for general information only. It reflects our perspective, our way of working and our experience at the time of publication.
No part of this content is a binding offer, a promise of a particular result or part of a contractual agreement. The actual services, their scope, prices and timelines are defined exclusively in the proposal and the contract signed with each client; nothing on the site changes or supplements those agreements.
Service descriptions on the site are general by nature, and the details of delivery may differ from one project to another depending on the client's needs, budget and schedule.
No professional advice
What we publish on the blog and across the site about marketing, branding, design, content and technology consists of general opinions and experience. It is not professional, legal, financial or technical advice tailored to your situation.
Do not make business, legal or investment decisions on the basis of the site's content alone. Consult a qualified professional who knows the details of your situation before acting, particularly regarding trademark registration, copyright and the regulatory compliance of advertising campaigns.
An actual advisory relationship between you and HAWJAN arises only through a written contract that defines the scope of work and the responsibilities.
Accuracy and provision “as is”
We make reasonable efforts to keep the site's content accurate and up to date, but we do not guarantee that it is free of errors, omissions or outdated information. Information (such as the list of services, the team or the work on display) may change without prior notice.
The site and its content are provided “as is” and “as available”, without warranties of any kind, express or implied, to the extent permitted by law, including warranties of fitness for a particular purpose, non-infringement or uninterrupted availability.
If you notice an error on the site, we welcome a note at info@hawjan.com and will correct it as soon as we can.
Portfolio and client work on display
On the work page and the home page we show examples of projects we have delivered and the logos or names of clients we have worked with. This is done with the client's permission or as allowed by the contract signed with them, and is intended to illustrate our experience, not to announce any ongoing relationship or endorsement of HAWJAN by the client.
Logos and trademarks appearing on the site belong to their owners and are shown for identification only. If you own a mark on display and would like it removed, write to info@hawjan.com and we will remove it.
Results we mention for any project (such as growth, engagement or figures) reflect that client's experience in its own circumstances and do not guarantee similar results for anyone else. Success in marketing and branding projects depends on many factors outside our control, such as the market, the product, the budget and timing.
Some of the work on display may have been produced in collaboration with partners or freelancers, or at an earlier stage of the team's journey.
External links
The site may contain links to websites, platforms or social accounts not operated by HAWJAN. We provide these links for your convenience only; their presence does not mean that we review, endorse or vouch for the accuracy or safety of those sites.
We have no control over those sites or their privacy policies, and we accept no responsibility for any harm arising from your use of them. We recommend reading the terms and policy of every site you visit.
Likewise, a link from an external site to ours does not mean that we endorse or are affiliated with that site.
Intellectual property
All content on the site — text, images, video, illustrations, designs, logos, icons, source code, and the way it is organised and presented — is protected by the copyright and trademark laws of the Kingdom of Saudi Arabia and by international treaties, and belongs to Hawjan or is licensed to it by its owners, unless stated otherwise.
Using the site grants you no right or licence in its content beyond the limited right to browse it and display it on your device for personal, non-commercial use.
Articles published on the blog belong to HAWJAN or to the named author. We may use AI tools as a drafting aid for some editorial content; our team reviews it before publication, and the rights and editorial responsibility remain with HAWJAN.
Trademarks and the HAWJAN mark
The names “هوجان” and “HAWJAN”, the distinctive brush-stroke mark and any other logos or visual identities appearing on the site are trademarks and brand assets of Hawjan. They may not be used, imitated, altered, combined with another mark, or used in any way that suggests an affiliation with or endorsement by HAWJAN without our prior written permission.
This includes using the logo in presentations, marketing material, websites or social accounts of other parties, even former clients of HAWJAN, unless agreed in writing.
If you are a journalist or partner and need the official logo files, write to info@hawjan.com and we will provide the approved files and guidelines.
Rights policy: what is allowed and what is not
You may do the following without asking permission:
- Browse the site, read its content and refer to it.
- Share links to the site's pages on social platforms or by email.
- Quote a short excerpt from an article with attribution and a link to the original page, within the limits of fair quotation.
The following is prohibited without prior written permission from Hawjan:
- Copying the site's content in whole or in part, republishing, distributing, translating or modifying it, or creating derivative works from it.
- Using the images, video, designs or work on display in any other context, or presenting them as your own.
- Using the site's content for commercial purposes, for training AI models, or collecting it automatically (scraping) beyond what the robots.txt file allows.
- Attacking the site's security, attempting to access the dashboard, or sending automated or misleading submissions through the forms.
Any use that breaches this policy may expose you to liability under the Copyright Law, the Trademark Law and the Anti-Cyber Crime Law of the Kingdom of Saudi Arabia. To request permission, write to info@hawjan.com.
Ownership of work delivered to clients
Rights in the work HAWJAN produces for its clients (identities, designs, content, films and more) transfer as set out in the contract signed with each client. As a rule, rights in the final approved work pass to the client once all fees are paid, while HAWJAN retains working files, drafts, unapproved proposals and its internal tools and methods, unless otherwise agreed in writing.
Unless the contract prevents it, HAWJAN keeps the right to show delivered work in its portfolio, on its website and on its accounts to illustrate its experience, subject to agreed confidentiality and any launch dates set by the client.
Any material a client provides for use in its project (logos, images, text, data) remains the client's property, and the client warrants that it holds the right to use it and to authorise us to use it.
Blog content and submissions
The blog publishes articles and news from the HAWJAN team and its guests. Opinions expressed in articles are those of the author at the time of publication, may change over time, and do not necessarily represent an official HAWJAN position on every matter.
The site does not currently allow comments on articles. Any material you send us voluntarily through the contact form or by email (ideas, suggestions, feedback) is considered non-confidential unless we agree otherwise in writing, and we may make use of it without obligation to you, while respecting your personal data in line with the Privacy Policy.
If you believe content on the site infringes a right of yours, write to info@hawjan.com identifying the content and the right claimed; we will review the request and take appropriate action.
Limitation of liability
To the fullest extent permitted by law, neither Hawjan nor its directors, employees or partners are liable for any direct, indirect, consequential or special loss or damage arising from:
- Your use of the site, your reliance on its content or your inability to access it.
- Any error, omission or delay in the content.
- Any virus or malicious software reaching your device as a result of using the site or linked sites, despite the precautions we take.
- Any interruption or failure of the site or of the external services it depends on (such as hosting or email).
- The actions of third parties or external sites we refer to.
Nothing above limits liability that the law does not allow to be limited, such as liability for fraud or for harm caused intentionally or by gross negligence. Our liability towards clients for contracted services is governed exclusively by the signed contract, not by this page.
Indemnity
You agree to indemnify and hold Hawjan harmless from any claim, loss, liability or cost (including reasonable legal fees) arising from your breach of these terms, your use of the content or marks beyond what is permitted, your infringement of another party's rights, or your misuse of the site's forms.
We reserve the right to assume the defence of any claim subject to this indemnity at your expense, and you agree to cooperate with us reasonably in doing so.
Availability and changes
We aim to keep the site available around the clock, but we do not guarantee uninterrupted availability. We may suspend the site or part of it temporarily for maintenance, updates, security reasons or causes beyond our control, without prior notice.
We reserve the right to modify the site's content, its services or these terms, or to discontinue any of them, at any time. Changes to this page apply from the date they are published, and the date of the last update appears at the top of the page. Continuing to use the site after a change means you accept the amended version.
If any provision of these terms is found unenforceable under the law, the remaining provisions remain in effect.
Governing law and jurisdiction
These terms and everything arising from the use of the site are governed by and interpreted under the laws of the Kingdom of Saudi Arabia, including the Copyright Law, the Trademark Law, the Anti-Cyber Crime Law and the Personal Data Protection Law.
The courts of Riyadh have jurisdiction over any dispute arising from or related to these terms or the site, unless a specific services contract provides otherwise in writing.
Our not enforcing any provision does not waive it; we may enforce it later.
Contact
To request permission to use content or a mark, to report a possible infringement, or for any question about these terms, write to Hawjan at info@hawjan.com or by post at Riyadh, Kingdom of Saudi Arabia.
